Infla Band 13 Urheberrechtverletzung??

Aus diesem Thread ist folgendes zu entnehmen. EIn gewisse Roger Smyczek hat Band 13 kopiert und in seinen Akten übernommen, Er hat dann einiges hinzugefügt und dann als eigene Arbeit verkauft. Liebenswerterweise hat er selber hierzu das Copyright für sich rechtlich anerkannt.

Was freilich nicht in dem Thread steht; hat er eine Genehmigung seitens Infla Berlin für die Überarbeitung des Textes.

Auch konnte ich nirgendswo sehen ob er die Quelle für 'seine' Arbeit angegeben hat.

Der Herr Roger S. ist unterdessen gestorben, aber einer will doch weitermachen und diese Daten sind fortan auf CD gebrannt und werden jetzt umsonst an Interessanten verteilt.

I would speculate that no one would get sued as Roger only copied INFLA-Book 13 into his own tables and reorganized it by cancel type.

He did put a copy right date on all the table pages, but not any of the text that he wrote in the preface or introduction.

He uses Michel numbers and as far as the text reads, there is no permission noted to use them, nor is there any mention that he had permission to copy all the tables from INFLA-Berlin.

I have already created a pdf file of the English written portion of his book (the first 15 pages + title page), but not the tables as INFLA-Book 13 provides all that information already. The English portion just better explains how the tables work (just remember that Roger’s book is sorted by cancel type, then alphabetical and INFLA-Berlin 13 is only sorted alphabetically). Some of the explanation of his book, the 5 cancel forms and the components of the cancels that are published in the book, he had posted as “freebies” on his web pages, so I would say that copies of his book, minus the tables, would be fair game to give away. Lets not get too picky about things because the reality is Michel #’s, which we freely use all the time here in the group, is in fact copy righted material by Schwaneberger Verlag and to use them legally requires permission from them as they have not given blanket permission to freely use their material, the same would apply to Scott numbers or Borek numbers etc. His book was published to order, and I believe the cost was $55.00 to cover the printing, material and possibly postage. At 75 pages, with the binder and the dividers, printed on heavy card stock, I would imagine he broke even on the deal (of course not counting time, which in business equals labor cost) to publish something to help fellow collectors.

Copy right is only on the tables, which came from INFLA-Berlin (so is that stealing, using someone else work and calling it your own?).

The other material was offered free use off the web site (which he stated was free as long as it wasn’t used for resale), therefore can be given away. Of course, I can just reword it, resort tables and call it mine, which is what Roger did (to make it easier for English speaking hobbyist to enjoy the hobby). I won’t as that is a lot of work and seems to draw criticism from people. So why bother sharing information with fellow collectors to enhance our hobby, if we end up being blamed for stealing?
